How to draw up and conclude a residential rental agreement?
The housing rental agreement is a written contract that is concluded between the landlord and the tenant of the housing. In order to draw up the contract, the following data must be specified:
- The names and addresses of the lessor and the lessee;
- The address of the apartment being rented;
- The amount of rent and the method of payment;
- The term of the lease and the conditions for termination of the contract;
- Responsibilities of the lessor and the lessee for the maintenance of the dwelling;
- Other conditions that are important for both parties.
In order to conclude the contract, the following steps must be completed:
- Negotiating the terms of the lease between the lessor and the lessee;
- Preparation of a written contract for renting a house;
- Signing of the contract by both parties;
- Submission of a copy of the contract to the relevant administration responsible for the registration of rental contracts.
Landlord's Rights:
1. Receipt of the rental price according to the conditions specified in the contract.
2. Taking a pledge or deposit and retaining part of it in case of breach of contract.
3. The right to enter the dwelling to check its condition or to carry out repair work, provided it is provided for in the contract or legislation.
4. Right to demand regular maintenance and repair of the apartment by the tenant.
5. Right to terminate the contract in case of serious violations by the lessee, in accordance with the legislation.
Tenant rights:
1. Use of the home in accordance with the contract and legislation.
2. Peaceful use of the home without interference by the landlord or third parties.
3. Right to privacy and privacy.
4. Receiving notice of a change in the rental price or other essential conditions of the rental contract in advance, according to the legislation.
5. Requirement of the necessary repairs and maintenance of the dwelling by the lessor.
6. Right to terminate the contract, under the conditions and with the terms provided for in the legislation.
Obligations of the lessor:
1. Provision of the home in a condition suitable for use.
2. Provision of relevant conditions for communal services (eg water, electricity and heating), if not otherwise specified in the contract.
3. Maintenance and repair of the dwelling, unless the responsibility is assumed by the tenant, according to the contract or legislation.
4. Observing the tenant's rights and respecting his privacy.
5. Refund of the pledge or deposit at the end of the rental period, after inspection of the condition of the apartment and fulfillment of all obligations by the tenant.
Obligations of the lessee:
1. Payment of the rental price within the term and in the amount specified in the contract.
2. Keeping the home in decent condition and protecting it from damage.
3. Notifying the lessor in case of problems or the need for repairs.
4. Observance of the rules for the use of the common parts of the building, if such exist.
5. Restoring the home in a condition similar to when it was handed over, except for acceptable normal wear and tear.
