Executive proceedings and auctions
Enforcement proceedings and judicial tenders are an important part of the legal system, representing a key mechanism for ensuring the enforcement of court decisions and decisions of other legal instances. They are intended to ensure justice and order in society and are regulated by special laws, including the Enforcement Proceedings Act and the Injunctive Proceedings and Judicial Auctions Act.
Enforcement proceedings are initiated with the specific aim of ensuring the execution of court decisions, acts and decisions issued by courts and other legal bodies. This may include decisions to recover debts, realize property or enforce other obligations. These proceedings are managed by bailiffs, specially trained and authorized persons who act in accordance with the law.
Court auctions are part of enforcement proceedings and represent a procedure for the public sale of property in order to satisfy claims and obligations. These auctions are conducted under the strict control of the bailiff and compliance with the rules laid down in the law. Property subject to auction includes real estate, chattels, equipment, vehicles and even property rights.
The law on enforcement proceedings regulates in detail the procedures and rules for the execution of court decisions and decisions of other bodies, as well as the rights and obligations of participants in enforcement proceedings. It defines terms, ways of exercising the rights and the basic principles according to which the performance is carried out.
Also, the Law on Security Proceedings and Court Auctions regulates the procedures and conditions for establishing security measures before the court decision, as well as the manner of holding court auctions and the sale of property.
