**Prohibition of Leaving the Country for a Child at Risk of Being Illegally Taken Abroad**
According to Article 32, paragraph 1, letter "b" of Regulation (EU) 2018/1862 of the European Parliament and of the Council of November 28, 2018, on the establishment, functioning, and use of the Schengen Information System (SIS) in the field of police cooperation and judicial cooperation in criminal matters, amending and repealing Council Decision 2007/533/JHA and repealing Regulation (EC) No 1986/2006 of the European Parliament and of the Council and Commission Decision 2010/261/EU (OJ L 312/56 of December 7, 2018).
1. The district court at the child's current address considers requests for a prohibition on leaving the country for a child when there is a specific and evident risk of illegal removal of the child by a parent, guardian, or relative.
2. It is illegal to remove a child with a habitual residence in the Republic of Bulgaria in violation of the right to effectively exercise parental rights and duties acquired under a decision, law, or agreement.
3. The proceedings begin at the request of a parent, guardian, or custodian. The court hears the other parent unless they appear without valid reasons. The court may, on its initiative, collect evidence.
4. The court immediately informs the border control authorities of the Ministry of Interior about the initiated proceedings. Until the court decision comes into force, the child may only leave the country by court order.
5. The court announces its decision within 14 days from the initiation of the case, and the prohibition on leaving the country may last for up to one year. The court may allow the provisional enforcement of the decision made.
6. The prohibition on leaving the country may be lifted by a decision of the district court at the request of a parent, guardian, or custodian if evidence is presented that the risk of illegal removal of the child has ceased. The court considers the request for lifting and informs the competent authorities.
This declaration provides the necessary legal protection and facilitates the border crossing process by ensuring that the child's travel is permitted and approved by their parents or guardians.
